On many occasions, when we acquire a property, it needs certain reforms to leave it completely to our taste. Even the wear and tear of the years requires us to modify it’s structure or make a series of internal improvements. All this implies certain licenses and permits, as well as regulations, which it is convenient for you to know before initiating any procedure with the architects.

A frequent question we receive at MAM Solicitors, is related to the process to be followed when staring up this type of work/renovation. In Spain, this requires a legal process that follows the regulations laid down to obtain the building licence, and to be able to start the relevant work.

It is important for you to know that the person ultimately responsible for applying for and obtaining this licence, despite the fact that it is done through an architectural firm, is always the owner of the property.

On the other hand, failure to obtain the licence or failure to present all the documentation required for validation and start of the work, may lead to a series of economic sanctions and even to the paralysis of the work until all the documentation is presented and reviewed, with the possible costs that this may generate.

In this sense, when we acquire a property or think about building on it, it is always good to be advised by a team of specialised lawyers to validate and review all the necessary documentation beforehand.

What happens if I want to sell my property once the work is done?

It may be the case that after some time, we make the decision to sell our property. It is even common to buy and renovate properties in Spain as an investment for a later sale.

In this case, any modification made to the original property must be registered in the so-called title deeds. To do this, three documents must be included:

    • License from the local town hall for the work
    • Certificate of project completion, to be issued by an architect
    • Project certificate of the completed project
